This Privacy Statement Buy It Mobility Networks (“BIM”, “we”, or “us) respects your privacy and protects it through the terms contained in this Privacy Statement.

This Privacy Statement describes the types of information we may collect from you or that you may provide when accessing the software or services provided by us (collectively, the “services”) and our practices for collecting, using, maintaining, protecting, and disclosing that information.

Buy It Mobility Networks Inc. (“BIM”), provides access to the Services that allow Customers to use the Services as a method of payment at enrolled businesses (each a “Merchant”) or third party networks, and, where applicable, BIM allows customers to receive coupons, marketing messages, or other incentive-based items for Merchants that may be used toward goods and services offered by a participating Merchant or network. The Services may be offered under BIM’s name or branded with the name of one of our participating Merchants or networks.  Among other features, the Services includes a payment settlement network for participating merchants using the Automated Clearing House (ACH) network.

BIM will take reasonable steps to protect user privacy consistent with the guidelines set forth in this policy and with applicable U.S. laws.  In this policy, “user” or “you” means any person using the Services, whether by browsing the BIM website or a mobile application using BIM technology, including any third party or white labeled websites or mobile applications, paying for items and/or transactions using the Services at physical or online points of sale, engaging in discount, rewards or other incentive programs offered by BIM merchants or networks, or participating in any other activities available through the Services. BY DOWNLOADING, ACCESSING OR USING THE SERVICES, INCLUDING USE OF OUR (OR OUR MERCHANT’S OR OTHER THIRD PARTY’S) WEBSITE, MOBILE APPLICATIONS OR OTHER PROGRAMS WHERE OUR APIS AND TECHNOLOGY ARE USED, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTAND, AND AGREE TO BE BOUND BY THIS PRIVACY POLICY AND OUR TERMS OF SERVICE. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE SERVICE.

Information we collect

Visiting our Website or Application Containing our Services.  This Privacy Policy applies to the information we collect when you visit our website or use an application with our Services or communicate with us through email, text, or other communications, we receive and collect certain information about you. The information that we receive and collect depends in part on what you do on our website or in the specific application. You may be able to improve your experience when you tell us who you are (e.g. by enrolling in our Services, making inquiries, or requesting further information about our Services). However, you can visit our website or certain parts of the specific application without revealing your identity. When you request information, we will ask you for your name and other personal information or obtain such data from third parties. You are free to choose whether to disclose this information to us or not.

This Privacy Statement does not apply to information collected by any third party through any application or content that may link to or be accessible on our website or application. We encourage you to review the privacy policies or notices of third parties for information about their practices.

Some of the information you may submit is personal information, but much of it is not. Personal information is information that can be used to ascertain your identity. This includes information such as your correct name, address, postal address, telephone number and, where applicable, information about your specific device. It does not include information that is not directly related to your actual identity.

We, or our third-party service providers, may use this information for a number of purposes, such as to better service your requests and/or inquiries, monitor website or application usage and/or performance, improve the customer experience of our website or application, ensure technological compatibility with your computer or phone or tablet, protect against fraud or identity theft, or conduct aggregate analyses on usage patterns.

If you give us information about another person, in doing so you confirm that they have given you permission to provide it to us to be able to process their personal information and that you have told them who we are and what we will use their data for, as set out in this Privacy policy.

Enrolling and Participating in Our Services.  In order to operate the Services, we must ask you to provide information about yourself and your checking account. The information we request may include, but is not limited to, information such as your name, address, email address, password, PIN, driver license or state/military identification number, date of birth, phone number, bank account information, and, where applicable, information about your specific device (“Personal Information”).

By completing the enrollment process, whether through a BIM application or website, or through a Merchant or third party application or website, you confirm your agreement with our processing, receiving, storing and using such information and our disclosure of such information to both our affiliated companies, third party service providers and/or authorized vendors for their role in providing the Services.

You also are authorizing us, our third party service providers and/or our authorized vendors, and our designees to verify your identity, verify your bank account, and confirm you are the owner of the bank account that you would like to use.

We also may collect information you provide to us through your communications with BIM. This may include records and copies of your correspondence (including your email addresses), information if you enter a promotion offered by a Merchant, or when you report a program with our website or application.

We also may collect information about when you use our Services, including as follows:

  • Transaction Information. When you use our Services to make payments, we collect information about when and where the transactions occurred, a description of the transactions, the payment amount, and information about the devices used to complete the transaction. This could include information about your location and Geographic Information Systems (“GIS”) data.
  • Use Information. We collect information about how you use our Services, including your access times, browser types and language, and Internet Protocol (“IP”) addresses.

We may also collect information about you from third parties, including but not limited to third-party verification services, credit bureaus, mailing list providers, and publicly available sources. In some circumstances, this information may include your Social Security or taxpayer identification number.

We also may obtain personal information from other sources, such as through mergers and acquisitions with other companies, as well as through commercial arrangements with third-party providers, business partners, and other sources. Information BIM receives from a third party is subject to your separate agreement with such third party, unless you enter into a separate agreement with BIM or otherwise give BIM your permission to use such information. BIM may merge information BIM receives from third parties with information BIM has collected or will collect subject to such limitations.

Updating account information.  BIM, or its authorized agents, will not modify your information without your permission, except in the case of correcting an obvious error (such as your zip code).  You are responsible for keeping your financial account information with the enrolled bank account up to date. You may update, correct or delete your information by contacting Customer Service as listed in the terms and conditions of your Enrollment for BIM Services. Unless otherwise noted herein, we will store your information throughout the tenure of our business relationship and for a period thereafter as needed for our business purposes.

Use of driver license information, including information on barcode or magnetic stripe.  By applying for a BIM payment account and enrolling your driver license information, you have voluntarily provided certain personal information to BIM or its authorized agents, to participate in the Services.

How We Use the Information We Collect.

We may use the information about you for the purposes described in this Privacy Policy or as otherwise disclosed to you through the application you use.  For example, we may use your information to:

  • Present our website and application and their contents to you;
  • Process and manage your purchase of products and services at participating merchants’;
  • Respond to your inquiries and requests;
  • Create and deliver personalized promotions, including combining your personal information with other information, such as the amount and types of purchases you make and benefits you receive;
  • Communicate with you by mail, telephone, facsimile, email, mobile alerts and SMS messaging, including about your use of the services;
  • To notify you about changes to our website or application or any product or service we offer or provide through them;
  • Further our business purposes, such as to perform data analysis, audits, fraud monitoring and prevention, to enhance, improve or modify the Services, to identify usage trends, determine effectiveness of promotional campaigns and to operate and expand our business activity;
  • For any other purpose with your consent.

In addition to those methods discussed in this Privacy Statement, we may use and share your information, including personal data, without limitation, in the following manner:

  • In response to judicial or other governmental subpoenas, warrants and court orders served on us in accordance with their terms, or as otherwise required by applicable law;
  • To comply with legal, regulatory or administrative requirements of governmental authorities;
  • To protect our rights or property, protect our legitimate business interests, to enforce the provisions of our terms or policies, in cases of customer fraud/disputes, and/or to prevent harm to you or others;
  • To assert, protect or defend us, our affiliates, or our authorized vendor(s) and designees and any of their officers, directors, employees, agents, contractors and partners, in connection with any legal action, claim or dispute;
  • As disclosed in other applicable policies, terms of use, or other agreements; or
  • As permitted or required by law or as authorized by you.

Aggregate Information. We or our affiliated companies, designees, merchants, and/or third party service providers may also use Personal Information to create aggregated data for analytical purposes. This statistical information does not contain any Personal Information and is used to understand our customer base and to better serve our market. BIM reserves the right to share such aggregate data with third parties, such as potential business partners, merchants, advertisers, and funding sources, or in order to describe our business and operations.

Email Communications & Marketing. If you create an account and provide your email address, we may send you administrative and marketing emails. All users receive administrative emails. If you wish to opt out of administrative emails, you must delete your account entirely and cease use of the Service.

We may use your personal data to provide you with direct marketing information about our products and services as well as those of our affiliates and third parties, and we may permit those affiliates or other third parties to send their own direct marketing to you. Our direct marketing may be by email, telephone, post or SMS or such other method(s) as may become relevant. In addition, we may provide direct marketing information and permit others to do that as allowed by our customers’ respective contracts.

We will take steps to seek to ensure that any direct marketing from us and which is sent by electronic means will provide a simple means for you to stop further communications, in accordance with applicable law. For example, in emails, we may provide you with an “unsubscribe” link, or an email address to which you can send an opt-out request. In addition, if we need your consent for direct marketing communications under applicable law, and if you provide your consent, you will be able to change your mind at any time.

Third parties.  At BIM maintaining your trust and confidence is our top priority. In addition to the disclosure reasons noted above, BIM may disclose your Personal Information to third parties from time to time.  These types of third parties may include merchants who use our Services to process payments (or those acting on their behalf), third party providers of white-labeled BIM applications, networks, distributors of our products and services, service providers or contractors retained to perform functions on our behalf or to provide services to us, including but not limited to, accounting, audit, consulting, legal, and other professional service providers, and providers of other services related to our business. Portions of our services may be provided by organizations with which we have a contractual relationship, including subcontractors, and, accordingly, your personal data may be disclosed to them. For example, BIM may use Plaid Inc. to gather your data for certain Services and, in such cases, Plaid Inc. will process your data in accordance with its Privacy Policy, which can be found here.

If, in the course of data processing, data is forwarded to service providers, we will be responsible for ensuring that your personal information continues to be protected with the same level of protection as if we were dealing with it directly.

We also may disclose your personal information to third parties: (a) in the event we sell or buy any business or assets, in which case we may disclose your personal data to the prospective seller or buyer of such business or assets; (b) if BIM or substantially all of its assets are acquired by a third party, in which case personal data held by us about our customers will be one of the transferred assets; (c) if we are under a duty to disclose or share your personal data in order to comply with any legal obligation, or in order to enforce or apply the terms of this privacy policy or any other agreements; or (d) to protect the rights, property or safety of BIM, our customers or others (and this includes exchanging information with other companies and organizations for the purposes of fraud prevention and credit risk reduction).

Network Operators. Use of the Services may involve use of the services of third party telecommunications carriers and service providers (such as the services of the carrier that provides cellphone service to you). Such carriers and service providers are not BIM’s contractors, and any information that a carrier collects about your use of the Services is not Personal Information and is not subject to this Privacy Policy. BIM is not responsible for the acts or omissions of telecommunications carriers or service providers.

Web/Mobile Tracking Information

BIM and its third-party service providers may use web and/or mobile tracking technologies, such as cookies, beacons, pixel tags and clear GIFs, to improve security, combat fraud and increase the users overall experience and to collect data related to usage of the Service, and any web or email marketing conducted by or on behalf of BIM or its Merchants. Such data may include:

  • the address of the websites you visited before and after you visited the Service,
  • the type of browser you are using,
  • your Internet Protocol (IP) address,
  • what pages in the Service you visit and what links you clicked on,
  • The identification for advertising associated with your iOS or Android device, and
  • identifiers of beacons communicated to a BIM App.

To collect Web/Mobile Tracking Information and to make your use of the Service more efficient, we may store cookies on your device. BIM and third party contractors engaged to provide services on behalf of BIM may also use web tracking technologies that are placed in web pages on the Service or in email communications to collect information about actions that users take when they interact with the Service or such email communications. Web Tracking information and Mobile Tracking information may be correlated to individual Users. Some Web Tracking Information may include data, such as IP address data, that is unique to you. You may be able to modify your browser settings to alter which web tracking technologies are permitted when you use the Service, but this may affect the performance of the Service.

Analytics

We collect data from users about their usage of the Services. The types of analytical information that are collected include the date and time the app accesses our servers, app version, the location of the device, language setting, what information and files have been downloaded to the app, user behavior (e.g. what features used, frequency of use), device state information, device model, hardware and operating system information, and information relating to how the app functions. We use this data to improve the quality and functionality of our Services; to develop and market products and features that best serve you and other users; and to help identify and fix app stability issues and other usability problems as quickly as possible.  We currently use Azure Application Insights for this purpose.  Further information from Microsoft about privacy and Azure can be found at: http://azure.microsoft.com/de-de/support/trust-center/privacy/

Security

We use reasonable security precautions to protect the security and integrity of your Personal Information in accordance with this policy and applicable law. However, no system or online transmission of data is completely secure, and we cannot guarantee that security breaches will not occur. You should always take appropriate security measures to protect your Personal Information, including insuring you have up to date anti-virus software.  Without limitation of the foregoing, we are not responsible for the actions of hackers and other unauthorized third parties.

Links. The BIM website, Merchant website, or Third Party website may contain links to other websites. BIM is not responsible for the privacy practices or the content of those websites. Users should be aware of this when they leave our website, and review the privacy statements of each third party website. This Privacy Policy applies solely to information collected by the Service.

Suspicious E-Mail. We will never e-mail you to request personal information over the Internet or by any other means. Help protect yourself against online fraud – if you suspect that an unsolicited e-mail is fraudulent, please contact us.

Children. Our website and application is not intended for persons under 13 years of age.  No one under the age of 13 shall provide any information to or on the website or application. BIM does not knowingly collect or maintain personally identifiable information from persons under 18 years of age, and no part of the Services is directed at persons under 18. If you are under 18 years of age, then please do not use the Services. If BIM learns that personally identifiable information of persons less than 18 years of age has been collected without verifiable parental consent, then BIM will take the appropriate steps to delete this information. Service Visitors from outside the United States. BIM and its servers are in the United States and are subject to the applicable state and federal laws of the United States. If you choose to access or use the Services, you consent to the use and disclosure of information in accordance with this privacy policy and subject to such laws.

Notification of Changes

BIM may revise its privacy policy from time to time. If we are going to use or disclose your personally identifiable information in a manner materially different from that stated at the time we collected the information, you will have a choice as to whether or not we use or disclose your information in this new manner.  We will post the amended Privacy Policy prominently on our website so that you are aware of what information we collect, how we use it and under what circumstances, if any, we may disclose it.  Your continued use after we make changes is deemed to be acceptance of these changes, so please check back periodically for updates.

Customer Service Correspondence

If you send us correspondence, including e-mails and faxes, we and/or our authorized agents retain such information in the records of your account. We and/or our authorized agents will also retain customer service correspondence and other correspondence from BIM or its authorized agents to you. We retain these records in order to measure and improve our customer service and to investigate potential fraud and violations. We may, over time, delete these records as permitted by law.
